未成年球员国际转会制度与儿童权益保护——以《儿童权利公约》为视角

摘　　要：以《儿童权利公约》为评价框架,对国际足联关于未成年球员国际转会的规定进行审视。研究发现,国际足联未成年球员国际转会制度与《儿童权利公约》的保护标准之间存在冲突,其根源在于足球治理体系中未成年球员利益的缺位。国际足联的未成年球员保护制度可通过放开未成年球员的国际转会限制、适当提高足球中介的准入门槛、限制经纪合同的最长期限予以完善,并在整体层面将未成年球员权益置于中心地位。With the Convention on the Rights of Children as the evaluation framework,the paper discusses the rules of FIFA on international transfer of minor players.The study finds that there is a conflict between the international transfer system for FIFA minor players and the protection standards of the Convention on the Rights of children,which caused the absence of the interests of minor players in the football governance system.FIFA's minor player protection system can be improved by removing the international transfer restrictions of minor players,appropriately raising the access standard of the football intermediaries,limiting the maximum period of brokerage contracts,and placing the rights and interests of minor players at the central position at the overall level.
