摘 要:2017年,国际体育仲裁院理事会通过了新的《亚洲运动会仲裁规则》(Arbitration Rules for the Asian Games),根据该规则,在雅加达亚运会期间,依亚奥理事会请求,国际体育仲裁院在赛事举办地设立临时仲裁庭,解决相关纠纷。该仲裁规则的管辖权条款存在瑕疵,因为该规则援引的《亚洲奥林匹克理事会章程》第34条规定所涵盖的纠纷范围过窄。建议亚运会临时仲裁应该扩大提起仲裁的主体范围,国内单项体育联合会应可以提起仲裁,未获参赛资格运动员应可以提起仲裁。亚奥理事会应该修改《亚洲奥林匹克理事会章程》第34条,将更多的纠纷纳入亚运会临时仲裁的受案范围。In 2017,the Council of Court of Arbitration for Sport adopted a new version of Arbitration Rules for the Asian Games.According to this rules,during the Asian Games in Jakarta,the Olympic Council of Asia(OCA)requested the Court of Arbitration for Sport to establish a temporary arbitral tribunal in the host city so as to resolve related disputes.However,the jurisdiction clause of the arbitration rules,quoted from Article 34 of the Constitution Rules of Olympic Council of Asia,is defective because the scope of disputes covered by it is too narrow.OCA should not only enlarge the scope of the party who can file an arbitration,such as national sports federations and unqualified athletes,but also modify the Article 34 of the Constitution Rules of Olympic Council of Asia,in order to include more disputes into the scope of accepting cases of the ad hoc arbitration during the Asian Games.
