论我国判例教学法的应用与拓展

摘　　要：判例教学法是公认的最成功的法学教学法。在我国实施判例教学法具有有效培养学生法律职业能力、不增加法学实践教学经费、提升司法公正的实践价值。成功开展判例教学法首先要编写符合判例教学需要的课程判例教学教程(教材),其次应选择在课程内容讲授后、在小班开展判例教学的教学模式,并且保障学生有充分的时间准备课堂判例讨论。判例作为教学素材也应在法律咨询、模拟法庭、优秀判例推选比赛、类案分析等实践教学中拓展应用。The Case method is recognized as the most successful legal teaching method.Its implementation in China has practical value of effectively cultivating students’legal professional ability without increasing legal practice teaching costs and enhancing judicial justice.To successfully carry out the case method,firstly,it is necessary to compile case teaching courses(teaching materials)that meet the needs of case teaching;secondly,it is necessary to choose the teaching mode of case teaching in small classes after the course content is taught,and ensure that students have sufficient time to prepare for case discussion in class.As teaching materials,case law should also be applied in practical teaching such as legal consultation,mock trial,excellent case selection contest and case analysis.
