大数据时代侵犯公民个人信息罪之法益分析——以《个人信息保护法(草案)》为视角

摘　　要：公民个人信息的概念应当以"可识别性"为基础,辅之以信息主体的可控制性来判断。侵犯公民个人信息罪是自然犯,其法益并不是超个人的法益,应当是个人法益中的个人信息权。信息自决权作为个人信息权的核心内容,其本质在于强调公民个人对信息的自我决定、自我处理之选择与控制的自由。基于信息自决权的独立性和对侵犯公民个人信息犯罪进行规制的必要性、从侵犯公民个人信息罪的构成要件分析、刑民一体化视野中法秩序的一致性理念等角度,在刑法角度应当限缩该罪的法益范围,以新型权利即信息自决权为具体法益予以阐明,更契合当今数据化和信息化时代对个人信息的保护宗旨。The concept of personal information of citizens should be judged on the basis of"identifiability",supplemented by the controllability of the subject of the information.The crime of infringing upon the personal information of citizens is a natural crime,and its legal interest is not a supra-personal legal interest,but the right to personal information,which is a personal legal interest.As the core of the right to personal information,the essence of the right to self-determination of information is to emphasize the freedom of self-determination,choice and control of information by the individual citizen.Based on the independence of the right to self-determination of information,the necessity of regulating crimes that infringe upon citizens’personal information,the analysis of the constituent elements of crimes that infringe upon citizens’personal information,and the concept of the consistency of the legal order in the vision of the integration of criminal law and civil law,the scope of the legal interest of this crime should be limited from the perspective of criminal law,and a new type of right,the right to self-determination of information,should be clarified as a specific legal interest,which is more in line with the current data and information age,and the demand for personal information for the protection of purpose.
