权力场域下的网络问责:范式转换、实践样态与异化风险

摘　　要：在互联网加持的信息化时代,权力场域下的特权意识、随意逾矩、乱法胡为等诸多问题很容易触发网络问责。网络问责是实体问责在互联网时代的发展与嬗变。互联网去权威化及分散化特质为公众话语表达创造了平等、开放、自由的能量场,并推动传统问责范式的转变。以网络曝光、网络扒粪和网络审判为实践样态的网络问责,并不尽然能达到网络问责的理想状态。网络空间权利滥用、责任缺失等诸多流弊,导致迫害性问责、偏激问责、无序问责等异化现象。如何规范网络问责,使之走向法治化、制度化轨道,是打造健康问责生态的关键。本文的研究重点是以制度化构建、网民自我赋能及网络公共性重塑等策略,建构有序的网络问责生态,进而启发政府规范权力运行,提升网络问责的应对能力。In the information age,abuses of power such as privilege,arbitrariness,misconducts and so on can be hold accountable through network.The decentralized network provides fair,open and free platforms for people to express their opinions,which promotes the transformation of traditional ways of holding the abuses of power accountable.However,network exposure,muckraking and trial may lead to many problems that hold the abuses of power accountable through forced,extreme and abnormal ways.Holding the abuses of power accountable in a legal and institutionalized fashion is the very core to build a healthy network accountability system.This article suggests constructing a well-organized network accountability system to facilitate governments to regulate the operation of their power and increase their capability to respond the claims that seek to hold the abuses of power accountable in network.
