摘 要:财富经生产而成,财富生产正义是财富原初获取正义的根本依据。劳动正义是马克思财富持有正义论的精神实质。马克思财富生产正义论从原初获取的意义界定了财富持有正义的根本主体、根本前提与基本条件。分配是社会主体获取财富实现财富持有的基本方式,马克思从财富形成阐述了按劳动贡献分配是分配正义的根本原则,从分配实行辨析了谁来分是实行分配正义的关键所在。交换是社会主体获取财富实现财富持有的重要途径,自愿的转让未必是正义的交换,马克思的劳动正义论说明了以价值量为基础进行等价交换才符合交换正义。维护财富持有丰富者的充分自由是诺齐克持有正义论的实质所在,否定劳动正义是诺齐克持有观的根本正义之失。Wealth is generated by production,and the justice of wealth production is the fundamental basis for wealth to obtain justice.Labor justice is the spiritual essence of Marx’s theory of wealth holding justice.Marx’s theory of wealth production justice defines the fundamental subject,premise and condition of wealth holding justice from the original meaning.Distribution is the basic way for the social subject to obtain wealth and realize the possession of wealth.Marx explained that distribution according to labor contribution is the fundamental principle of distribution justice from the perspective of wealth formation,and that the key to the implementation of distribution justice lies in who divides the distribution according to the implementation of distribution.Exchange is an important way for social subjects to obtain wealth and realize wealth holding.Voluntary transfer is not necessarily a just exchange.Marx’s theory of labor justice states that only an equivalent exchange based on the quantity of value can meet the justice of exchange.Maintaining the full freedom of the rich is the essence of Nozick’s theory of justice,and denying labor justice is the loss of fundamental justice of Nozick’s view.
