数字时代音乐版权默示许可制度研究

摘　　要：传统音乐版权之“一对一”授权许可模式因为效率不高,已经无法适应数字时代人们对效率的追求。作为一种新兴的授权许可模式,音乐版权默示许可制度因高效率特点受到关注。通过论证音乐版权默示许可的必要性与正当性,提出适时进行立法规范的建议。通过立法明确音乐版权默示许可成立的条件,划定音乐版权默示许可的适用范围,确定其适用对象,合理确定当事人之间的权利义务,建立惩罚性赔偿机制督促当事人主动履行义务,以此规范音乐版权默示许可行为和保护音乐版权默示许可相关主体的合法权益。The"one-to-one"licensing model of traditional music copyright can not meet the real demand for efficiency in the digital age because of its inefficiency.As a rising licensing model,the implied license system of music copyright has attracted attention because of its high efficiency.Through the demonstration of the necessity and legitimacy of implied license of music copyright,the author puts forward some suggestions on the legislation and regulation in time.The conditions for the establishment of implied license of music copyright shall be clarified by legislation,the scope of application of implied license of music copyright shall be defined,the applicable object shall be determined,the rights and obligations between the parties shall be reasonably determined,and the punitive compensation mechanism shall be established to urge the parties to perform their obligation voluntarily,to regulate the behavior of music copyright implied license and protect the legitimate rights and interests of related subject.
