集体经营性建设用地市场化流转背景下生态补偿的实现机制

摘　　要：当前,集体经营性建设用地市场化流转的逐利性使其在用途上倾向于能带来更多经济效益的工商业用途,却对农地生态安全造成严重的不利后果,体现在:以向外排放为附产品的集体经营性建设用地市场化流转引起农地环境污染、以资源索取为目标的集体经营性建设用地市场化流转造成了农地生态破坏,以资源消耗为特征的集体经营性建设用地市场化流转造成农地生物多样性的衰竭。因此,集体经营性建设用地市场化流转背景下建立农地生态补偿具有现实必要性,应当对农地生态补偿的主体与客体、标准、期限、方式等基本要件进行合理设计,这对于促进生态补偿的实施至关重要。在管理机制方面,应构建生态补偿的协调联动机制、公众参与机制、绩效评价机制、生态追责机制等;在保障机制方面,应注重法律保障、政策保障、经费保障、宣传保障等。At present,the profit-seeking goal of market-based circulation of collective operating construction land makes it inclined to industrial and commercial uses that can bring more economic benefits in use,but has serious adverse consequences for the ecological security of agricultural land,and the results are as follows:The market-based circulation of collective operating construction land with the external discharge as the subsidiary product causes the environmental pollution of agricultural land,the market-based circulation of collective operating construction land with the target of obtaining resources causes the ecological damage of agricultural land,and the market-based circulation of collective operating construction land with the characteristic of resource consumption causes the depletion of the biodiversity of agricultural land.Therefore,it is necessary to set up agricultural land’s ecological compensation under the background of market-based circulation of collective operating construction land.The establishment of such a compensation,we should reasonably design the basic elements of agricultural land ecological compensation,such as the subject and object,the standard,the time limit and the way,etc,and it is very important to promote the implementation of ecological compensation.In order to promote the realization of ecological compensation for agricultural land under the background of market-based circulation of collective construction land,in terms of management mechanism,the coordinated mechanism,public participation's mechanism,performance evaluation’s mechanism and ecological accountability’s mechanism of ecological compensation should be established,and the guaranteed mechanism should be based on law,policy,fund and propaganda.
