大学生犯罪情况、原因及防范研究--基于近五年550例裁判文书的统计分析

摘　　要：通过对近5年大学生犯罪案件裁判文书的梳理发现:大学生犯罪数量呈上升趋势,犯罪案件类型广泛、多元,犯罪已经不再局限于几种罪名;大学生犯罪被判处刑罚多为6个月以上3年以下有期徒刑,但也不乏重刑。大学生涉嫌犯罪的原因主要有:大学生家长犯罪,而大学生未能制止并参与;对违法犯罪后果的严重性认识不足被他人利用;和他人发生争执不能妥善解决;没有正确的金钱观,为获得金钱进行诈骗;没有正确的爱情观,不能理性处理感情问题。因此,应通过采取构建和谐守法家庭、对大学生加强道德和法纪教育、增强国家对网络的管理、提高大学生就业等多种措施来减少大学生犯罪。Through combing the judgment documents of college students’criminal cases in the past five years,it is found that the number of college students’crimes is on the rise.The types of crimes are wide and diverse,and crimes are no longer limited to a few crimes;college students are often sentenced to 6 months to 3 years of penalties for crimes of a fixed-term imprisonment,and there is no shortage of severe sentences.The main reasons for college students’suspected crimes are:college students’parents are committed crimes,but college students failed to stop and participate;college students are lack of understanding of the seriousness of the consequences of illegal crimes and being used by others;college students have disputes with others and cannot properly resolve;college students are lack of a correct view of money to obtain money;college students do not have a correct view of love and deal with emotional issues irrationally.Therefore,various measures should be taken to reduce college students’crimes by building a harmonious and law-abiding family,strengthening moral and legal education for college students,strengthening the management of internet,and improving college students’employment.
