摘　　要：随着国际商事仲裁日趋诉讼化,众多仲裁机构为满足对争议解决程序效率的追求引入了快速仲裁程序。为了高效地解决争议,快速仲裁程序通常包含特殊的限制以缩短程序周期。因此,并非所有的案件都能适用快速程序。为确保合理地适用快速仲裁程序,快速仲裁程序适用条件的设置非常关键。本文将按照仲裁程序发展的时间顺序,通过探讨不同仲裁规则下当事人、仲裁机构和仲裁庭在确定快速仲裁程序适用时所扮演的角色、发挥的作用以及三者之间的互动,深入探究快速仲裁程序适用条件的设置。不同仲裁规则下快速仲裁程序适用条件的区别体现在当事人意思自治和仲裁机构/仲裁庭自由裁量权的分配上。这种权利和权力的分配实质上反映了仲裁的内在价值在仲裁程序中的动态平衡。在分析众多仲裁机构采用的设置方法之后,本文还将进一步探索设置最佳适用条件的可能性。With the increasingly litigious character of international commercial arbitration and the growing desire for the efficiency of dispute resolution process,expedited procedure is introduced into international commercial arbitration.In order to resolve disputes in an expedited and efficient manner,expedited procedure contains special restrains to shorten the time limits of the proceeding.With such restrains,it is important to ensure that the case is manageable in the framework of expedited procedure.Thus,the threshold of the expedited procedure,as the gateway of the fast track,plays a critical role.This thesis will take a chronological look into the thresholds of the expedited procedure by discussing the roles and interactions of three arbitration players in determining the use of the expedited procedure under different arbitration rules.The thresholds of the expedited procedure in different arbitration rules are distinguished by the distribution of the parties’rights and the institution/arbitral tribunal’s powers.Such distribution indicating the relationships and interactions of these roles,in its essence,reflects a dynamic balance of the innate values of arbitration during the arbitral proceedings.This thesis will further explore the possibility of the“best”threshold of the expedited procedure after a thorough investigation and analysis of various approaches taken by arbitration institutions.
