摘 要:在新科技应用带来的法律问题研究背景下,从无人船应用法律规制的应然性与实然性入手,进行无人船法律规制的基本原则分析和人工智能治理下国际海事规则路径构建。把国际海事规则的叙事背景与人工智能治理下海事法律规范相结合,论述人工智能治理需建立在技术逻辑与法律逻辑对接的基础上方能深入研究人工智能法律体系的建构,力图在丰富人工智能治理理论和具体行业实践的结合上做出有益的探索。In the context of the research of legal issues brought by new technology,this article starts with the ought and practicability of the legal regulation of MASS,and analyzes the basic principles of the legal regulation of MASS and constructs the international maritime legal path under artificial intelligence governance.Combining the narrative background of international maritime rules with the dimensions of maritime legal norms under artificial intelligence governance,discussing that artificial intelligence governance needs to be built on the basis of technological logic and legal logic.It can in-depth study the construction of artificial intelligence legal systems,and strive to enrich artificial intelligence.The combination of intelligent governance theory and specific industry practice has been explored.
