商事法治现代化之场景金融的领域法学思考

摘　　要：领域法学关注文化、卫生、财税、金融等特定领域,属于社会中具有交又性、整合性的法律现象,与部门法学间形成要素互通、一体两面的同构而又互补的关系。商事法治现代化建设为场景金融发展提供了契机,场景金融发展的商事法治建设也要求领域法学视角的综合法跟进。可考虑建构“一体两翼”的综合法律责任承担体系、拟定多学科作用的行为标准来指引规范场景金融活动,以领域法学的积极应对推进场景金融的法治化建设。Science of Field law focuses on the intersectional and integrated legal phenomena in the society in specific fields such as culture,health,fiscal,taxation,and finance.The relationship between Science of Field law and Department Law is identical but complementary.The modernization of commercial law helps to develop the Scene Finance.The construction of leged framework in the development of Scene Finance also requires the follow-up of construction from the Science of Field law.It is reasonable to consider building a comprehensive legal responsibility system of“One Body and Two Wings”.It can also draft a multi-disciplinary behavior standard to guide and regulate Scene Financial activities.Science of Field law should actively respond to the constriction of legalization in Scene Finance.
