摘　　要：预印本是随着网络兴起的一种电子出版物,与传统纸质出版物相比,预印本未经同行评议就将技术内容向社会公开。预印本技术公开给申请专利的新颖性审查带来巨大挑战,因此,要在相关专利法规定中明确新颖性宽限期,满足科学技术的发展需要,并使专利法和科学研究达到平衡。Preprint is a kind of electronic publication with the rise of the Internet.Compared with traditional paper publications,preprint makes the technical content public without peer review.The disclosure of preprint technology brings great challenges to the novelty examination of patent applications.Therefore,it is necessary to specify the grace period of novelty in the relevant patent law,so as to meet the needs of the development of science and technology,and balance the patent law and scientific research.
