论非法经营罪中兜底条款的适用——以刑法修正案(十一)为视角

摘　　要：非法经营罪兜底条款的设置具有必要性和合理性,但因其内容的概括性,导致在司法实践中常被过度扩张适用。深受积极刑法观影响的刑法修正案(十一)将一些非法经营行为规定为轻罪:一是排除了非法经营罪兜底条款的适用;二是彰显本罪兜底条款的适用范围应最终由立法机关界定。鉴于立法的稳定性,司法实践中可以由最高司法机关通过司法解释的方式对兜底条款的具体适用对象先行列举明确,待时机成熟时再通过立法方式对其修订和完善。应在坚守罪刑法定原则之下,严格依据刑法总则第96条的规定来认定本罪中的“国家规定”;应在坚守体系解释、同类解释、同质解释的前提下,结合行为的实质危害性来综合判定“其他扰乱社会秩序的行为”。It is necessary and reasonable to set up the provision for the crime of illegal business operation,but it is often overextended and applied in judicial practice because of its generality.Affected by the positive view of criminal law,the Amendment to Criminal Law(XI)stipulates some illegal business activities as misdemeanors.First,it excludes the application of the provision of the crime of illegal business;and second,it shows that the scope of application of the provision of the crime of illegal business operation should be defined by the legislature.In view of the stability of legislation,in judicial practice,the specific applicable objects of the clause can be listed and clarified by the highest judicial organ in the way of judicial interpretation.When the time is ripe,it will be revised and perfected by legislation.Under the principle of legality of crime and punishment,the“state regulation”in this crime should be determined strictly according to Article 96 of the General Provisions of Criminal Law.On the premise of adhering to systematic interpretation,homogeneous interpretation and homogeneous interpretation,the comprehensive judgment of“other behaviors that disturb social order”should be made based on the substantial harmfulness of the behaviors.
