总体国家安全观视角下的国家安全刑法保障

摘　　要：总体国家安全观的提出扩充了国家安全领域的外延,也给利用刑法保障国家安全在理论和实践上提出了挑战。“国家安全”概念在《宪法》《刑法》《国家安全法》中的不同内涵不但阻碍了不同学科的交流,而且造成了国家安全立法和司法的错位。要在双重维度上解读“国家安全”,《刑法》中的“国家安全”概念一方面要以前置法的概念为基础,另一方面也要坚守刑法立场,符合刑法最后保障法的性质。在总体国家安全观视野下,要适当扩大危害国家安全犯罪的范围,通过引入“类型思维”来科学认定国家利益,合理区分国家利益和公共利益,提升和完善刑法保障国家安全的理念和路径。The proposal of the overall national security concept expands the extension of the national security field,and poses a theoretical and practical challenge to the use of criminal law to protect national security.The different connotations of the concept of"national security"in the"Constitution","Criminal Law",and"National Security Law"not only hinder the exchange of different disciplines,but also cause the dislocation of national security legislation and justice.To interpret"national security"in a dual dimension,the concept of"national security"in the Criminal Law should be based on the concept of pre-law on the one hand,and on the other hand,it should stick to the criminal law standpoint,which is in line with the nature of the criminal law's final guarantee law.From the perspective of the overall national security concept,it is necessary to appropriately expand the scope of crimes endangering national security,scientifically identify national interests by introducing"type thinking",reasonably distinguish national interests and public interests,and improve and improve the criminal law's concept and path to guarantee national security.
