摘 要:拆迁人违反拆迁补偿安置协议将安置房屋转卖第三人的,被拆迁人或行使优先取得权,或解除协议请求赔偿损失。在我国现行法规范缺失的情况下,结合理论及实务等理由,优先取得权以及解除协议后赔偿损失请求权的性质可界定为债权请求权。同时,基于权利内容的特性、主从权利理论、与其他请求权的对比分析以及相关规则的衔接等,可认定二者均属于《民法典》第196条第4项“不适用诉讼时效的其他请求权”。Demolisher violates the compensation and resettlement agreement concerning demolition and resells the resettlement house to a third party,and the demolished person may exercise the right of priority or claim compensation for damages after the agreement is terminated.In the absence of current laws and regulations in China,the nature of the right to obtain priority and claim compensation for damages after the cancellation of the agreement can be defined as the right to claim,based on the theory and practice.At the same time,based on the characteristics of the content of the rights,the theory of principal and subordinate rights,the comparative analysis with other claims,and the convergence of related rules,both can be considered as"other claims not subject to the statute of limitations"in Article 196,Paragraph 4 of the Civil Code.
