摘　　要：网络舆论冲击下,我国各地政府可能会偏离依法行政的轨道。通过分析50个已发生的网络舆论对依法行政产生了影响的案例,考察依法行政的完整程序、基础程序、跳跃程序,有助于廓清网络舆论影响下政府依法行政的偏离情况。研究结果显示,虽然社会误以为政府在应对网络舆论时被“绑架”而频频违法行政,但实际上我国政府在网络舆论的压力下,其绝大多数行政管理活动都遵守了依法行政的起码底线。值得警惕的是,从收集到的研究对象来看,有30%的案例背离了依法行政的要求,这种偏离肇源于政府忽视了“率先发声”、网络舆论涉入了不应参与的行政管理环节等。针对这种现实,未来需要在保障好人民群众通过网络当家作主、参政议政的权利外,还需要通过主动引导舆论、设置网络参与行政管理的合理限度等方式来提升网络舆论压力下政府依法行政效能。Under the impact of online public opinion,local governments across China often deviate from the track of administration according to law.In order to clarify the deviation of the government’s administration,we collected 50 administrative cases that have already had a substantial impact on administration according to law as research objects.By examining the“Complete procedures”,“Basic procedures”,and“Skipping procedures”of administration according to law,we clarify the deviation of the government’s administration.The research results show that:although the society mistakenly believes that the government has been“abducted”in response to Internet public opinion and had frequently led to illegal administration.However,under the pressure on Internet public opinion,most local governments have complied with the baseline of administration according to law. It is worthwhile to note that 30% of administrative management activities deviate from the requirements of administrative administration according to law and this deviation stems from the government’s neglect to “taking the lead”, and online public opinion involves administrative management processes which should not be involved. In accordance with this situation, we need to ensure the function of the people as the masters of the Internet and participating in political affairs in the future.
