算法定价歧视的反垄断法律规制

摘　　要：随着算法技术的不断发展,以互联网为依托的电子商务市场不断壮大,算法动态定价越来越多被运用于网络市场交易中。由于算法的专业性、复杂性和动态性等特点带来双方信息不对称、主体范围扩大和歧视行为更隐蔽等问题,对传统反垄断法对价格歧视的规制发起了挑战。因此本文建议设立算法审查和备案制度、完善主体认定标准并引入竞争损害和经济效率标准来对定价算法进行反垄断法律规制。With the continuous development of algorithmic technology,the e-commerce market based on the Internet continues to grow,and algorithmic dynamic pricing is increasingly used in online market transactions.Due to the professional,complex and dynamic characteristics of the algorithm,the information asymmetry between the two parties,the expansion of the subject scope and the more concealed discriminatory behavior,have challenged the regulation of price discrimination in the traditional anti-monopoly law.Therefore,this article proposes to establish an algorithm review and filing system,improve the subject identification standards,and introduce competition damage and economic efficiency standards to implement anti-monopoly laws and regulations on pricing algorithms.
