摘　　要：刑事政策范式包括刑事立法政策范式、刑事司法政策范式和刑事执行政策范式。刑事立法政策范式是刑事政策的基石,刑事司法政策范式是刑事政策的核心,刑事执行政策范式是刑事政策的归宿。刑事立法政策范式产生的刑事立法、刑事司法和刑事执行自成体系,在刑事法治实践之内相辅相成,它是一种自证预言,能够证明自身的正确性。人类历史上先后经历了四种类型的刑事司法政策范式:“从宽从轻”政策范式、“从宽从重”政策范式、“从严从轻”政策范式和“从严从重”政策范式。隐性政策指基于共同的执政理念、意识形态和社会思潮,而为各地执政者不约而同所采取的做法,通过对“重视惩罚指数”和“重视改造指数”的大数据分析,可以发现隐性刑事执行政策范式。刑事政策三种范式及其法治实践自创生一个耗散结构,并表现出自组织的发展和进化。Criminal policy paradigm includes criminal legislative policy paradigm,criminal justice policy paradigm and criminal enforcement policy paradigm.The criminal legislative policy paradigm is the cornerstone of the criminal policy,the criminal justice policy paradigm is the core of the criminal policy,and the criminal enforcement policy paradigm is the result of the criminal policy.The criminal legislation,criminal justice,and criminal enforcement generated by the criminal legislation policy paradigm are self-contained systems,which complement each other within the practice of criminal rule of law.It is a self-fulfilling prophecy that can prove its correctness.Human history has experienced four types of criminal justice policy paradigms:"loose and tender"policy paradigm,"loose and severe"policy paradigm,"strict and tender"policy paradigm,and"strict and severe"policy paradigm.The implicit policy refers to the relatively consistent approach adopted by rulers around the world based on a common governing philosophy,ideology and social thinking.Through big data analysis of the"attention on punishment index"and"attention on reformation index",it can be found Implicit criminal execution policy paradigm.The three paradigms of criminal policy and the practice of rule of law create a dissipative structure and show the development and evolution of self-organization.
