运动休闲特色小镇政策法规体系研究

摘　　要：通过梳理我国运动休闲特色小镇相关政策法规体系,结合2020年山西省13个体育小镇田野个案进行研究。该体系依托“法律”和“政策”两条主线:以《宪法》为根本准则,以《体育法》和《旅游法》为法律基础,以《公共文化服务保障法》为法律保障,以《村庄和集镇规划建设和管理条例》为建设纲领,以《全民健身条例》和《公共文化体育设施条例》为主线,架构起运动休闲特色小镇的法律体系;以全民健身和乡村振兴两大国家战略为龙头,以体育产业和旅游产业政策为核心,以特色小镇发展为导向,以运动休闲特色小镇政策为主干,以城乡供给侧结构性改革为发展动力,以《“健康中国2030”规划纲要》为制度保障。研究认为,存在如下不足:(1)小镇政策法规体系和创新协调发展机制不完善;(2)难以突破新型城镇化和乡村振兴战略实施的权力条块;(3)政策的诠释出现偏差以及政策执行与实施不到位。建议:建立健全运动休闲特色小镇政策法规体系;强化运动休闲特色小镇治理能力和协调机制;加强运动休闲特色小镇政策创新和实践运用,为运动休闲特色小镇建设和发展保驾护航。Through the collection and investigation of literature data,we have sorted out the relevant policies and regulations for the construction and development of sports and leisure towns in China in recent years.The system passes the two main lines of“law”and“policy”:the Constitution as the basic norms,the Sports Law and Tourism Law as the legal basis,the Public Cultural Services Guarantee Law as the legal guarantee,and the construction guidelines of the Regulations on Planning,Construction and Management of Villages and Towns,based on the National Fitness Regulations and Regulations on Public Cultural and Sports Facilities,establish the legal system of sports and leisure towns;use national fitness and revitalize the country’s two national strategic policies The document is the leader,with the sports industry policy and the tourism industry policy as the core,the characteristic town development policy as the guide,the sports and leisure characteristic town policy as the mainstay,the urban-rural supply-side structural reform as the driving force for development,and the Healthy China 2030 Outline for policy protection.The research believes that there are the following deficiencies:(1)the sports and leisure characteristic town policy system is not clear,and the innovation,coordination and integration development mechanism is not sound.Suggestions:to establish a sound policy system for sports and leisure towns;to improve the governance and coordination mechanism of sports and leisure towns;to strengthen the innovation and practical application of sports and leisure towns to escort the construction and development of sports and leisure towns;(2)it is difficult to break through the power block system of the new urbanization and the strategy of revitalizing the countryside;(3)lack of small towns to implement the national fitness and health China strategy.
