摘  要:解决困境未成年人家庭教育保障问题是预防未成年人犯罪的有效对策之一。目前我国困境未成年人家庭教育欠缺全面、有效的保障体系。应通过国家统筹监管,以分类保障为原则,通过分类施策、分类落实的路径,实现困境未成年人家庭教育保障体系的精准化、制度化构建。首先,应明确"困境"的概念与分类,以有针对性地解决问题为目标,根据不同需求,分类制定不同的保障机制和策略,从而精准攻坚各类困境情形;其次,建立以《家庭教育法》为核心的国家家庭教育法治体系,并以《家庭教育法》统一指导、相关政策法规辅助指导、相关法律制度具体指导为原则,分类逐步开展策略落实及制度保障举措,从制度层面有效保障困境未成年人家庭教育的正常、正确实施。Solving the problem of family education guarantee for minors in difficulties is one of the effective countermeasures to prevent juvenile delinquency.At present,the family education of minors in difficulties in China is lack of a comprehensive and effective guarantee system.It is necessary to achieve the precise and institutionalized construction of the family education guarantee system for minors in difficulties through national overall supervision,based on the principle of classified guarantee,and through the path of classified strategy and classified implementation.First of all,the concept and classification of"difficulties"should be clarified.With the goal of targeted problem solving,different guarantee mechanisms and strategies should be formulated according to different needs so as to accurately solve all kinds of difficults;secondly,the national family education legal system with the"Family Education Law"as the core should be established.Under the unified guidance of the "Family Education Law",the assistant guidance of relevant policies and regulations and the specific guidance of relevant legal systems,we can classify and gradually carry out the measures of strategy implementation and system guarantee.From the system level,we can effectively guarantee the normal and correct implementation of family education for minors in difficulties.
