环境法律制度对环境规制效率的影响实证分析

摘　　要：番环境法律制度是实现环境治理的重要手段。近年来,生态环境法律制度密集出台,然地方环境法律和政策落实难、执法低效问题仍十分严重。基于环境问题引发的多原因性,突破规范性法学研究视角,引入环境规制和成本收益理论,从环境规制效率维度对我国当前环境法律制度进行实证检验分析,探寻影响我国环境法律制度实施的内在机理和成因。通过实证研究得出,要加强市场调节因素引导,增加科学合理有效制度供给,强化环境行政制度、监察制度和监测制度等环境规制管理制度,以助力我国环境治理体系和治理能力现代化建设。The environmental legal system is an important means to achieve environmental governance.In recent years,the ecological environment legal system has been promulgated intensively,but the problems of local environmental laws and policies are difficult to implement,and the inefficiency of law enforcement is still very serious.Based on the multi-causes caused by environmental problems,the paper goes beyond the perspective of normative legal research,introduces environmental regulation and cost-benefit theory,conducts empirical testing and analysis of my country’s current environmental legal system from the perspective of environmental regulatory efficiency,and explores the internal mechanism that affects the implementation of my country’s environmental legal system and cause.Through empirical research,it is concluded that it is necessary to strengthen the guidance of market regulation factors,increase the supply of scientific,reasonable and effective systems,and strengthen environmental administrative systems,supervision systems,and monitoring systems,etc.,to help modernize the country’s environmental governance system and governance capabilities.
