中国未成年人司法制度的建构路径

摘　　要：我国未成年人司法的制度构建不应当继续停留在成年人司法的例外规定层面,而是需要一个专门的解决方案。考察各国少年法所体现出的福利性、保护性乃至惩罚性特征可知,我国应当形成具有专门、独立性质和福利色彩的综合性未成年人司法制度。具体思路是,在坚持最有利于未成年人原则、综合保护原则、比例原则、专门保护原则的前提下,进一步提炼未成年人的司法规则,系统建构包含适合罪错未成年人的保护处分措施、注重保护未成年被害人的权利与救助的临时性保护措施、从仅仅关注未成年人罪错行为扩展为包括未成年人民事行政权利的综合司法保护、国家主导多元化主体共治的保护体系在内的具有中国特色的未成年人司法制度。The juvenile justice system of China should not continuously be constructed as an exception to provisions on adult justice,instead a special solution is required.In view of the welfare,protective and even punitive features of juvenile laws in various countries,China should form a comprehensive juvenile justice system with special,independent nature and welfare feature.The specific idea is to further refine judicial rules on juveniles,systematically construct juvenile justice system with Chinese characteristics containing protectively disciplinary measures applicable to juvenile delinquents,temporary protection measures with focus on protecting juvenile victims’rights and aids,comprehensive judicial protection of juveniles’civil and administrative rights from only focusing on the juvenile delinquency,state-led protection system with multiple subjects for co-governance,on the premise of adhering to principles of being most favorable to juveniles,comprehensive protection,proportionality and special protection.
