摘　　要：2020年1月暴发的新型冠状病毒疫情给我国对外经贸行业带来了较大的冲击,部分企业由于事先在合同中订立了国际商事仲裁条款,采取仲裁的手段,减少损失。在国内疫情趋于稳定、国外疫情仍旧严峻的今天,如何推动合同的履约,顺利将货款收回,是当下众多进出口贸易企业最关心的问题。从一则案例出发,探析如何实现合同履约的风险防控。研究发现,从事国际贸易的企业需充分重视贸易伙伴与贸易术语的选择、合同相关单据的填制等方面,尤其需要注意合同中规定的不可抗力条款。The outbreak of the COVID-19 epidemic in January 2020 has brought a greater impact to our country's foreign economic and trade industries.Many companies went bankrupt due to the breach of contract by the foreign counterparty,and some companies have adopted arbitration methods to reduce their losses to a small amount because they have entered into an international commercial arbitration clause in the contract in advance.Today,when the domestic epidemic situation is stabilizing while the foreign epidemic situation is still severe,how to promote contract performance and smoothly recover the payment is the most concerned issue of many import and export trading companies.Starting from a case,this article explores how to realize the risk prevention and control of contract performance.Research has found that companies engaged in international trade need to pay full attention to the selection of trading partners and trade terms,and the filling of contract-related documents,especially the force majeure clauses stipulated in the contract.
