摘　　要：近年来,人工智能的司法应用顺应了时代的发展,实现了司法推理的智能化、裁判模式的标准化和司法审判的自动化。但这一应用在具体实践中,存在着智能化推理影响司法公正的实现、标准化裁判程序导致司法实践固化和司法霸权的产生、提前化预测模式削弱法官的自由裁量权等问题。在司法实践中合理应用人工智能,需要建构司法推理矫正模式,公开算法逻辑和第三方监督,明确人工智能的司法辅助地位,从而更好地推进人工智能司法建设。In recent years,the judicial application of artificial intelligence conforms to the development of times,realizing the intelligent judicial reasoning,the standardization of the judging mode and the automation of the judicial trial.However,in practice,there are some problems,such as the influence of intelligent reasoning on the realization of judicial justice,the solidification of judicial practice and the generation of judicial hegemony due to the standardized judging procedure,and the weakening of the discretion of the judge due to the advance prediction model.Reasonable application of artificial intelligence in judicial practice requires the construction of judicial reasoning correction mode,the disclosure of algorithmic logic and third-party supervision,and the clarification of the role of artificial intelligence in judicial assistance,so as to better promote the judicial construction of artificial intelligence.
