摘　　要：知识产权法采取的是传统法理学的语言和概念,而诚信社会建设主要利用的是功利主义和政治经济学的资源。在诚信社会建设背景下,衡量知识产权领域各主体行为是否合法正当还有另外的标尺,这个标尺即信用。传统上,每个国家的法律体系都是以规制侵权、违约、违法犯罪行为的形式作分类,失信行为是另一个特殊的种类,它涵摄了以上几种行为形式,但这显然是一种新的划分行为的基本方式。信用条款进入法律体系,未来社会可能会在守信激励和失信惩戒机制的推进中发生剧变。当代对于知识产权领域信用问题的研究不应仅仅是具体的和回应性的,即针对现实问题做出具体回应,而须更具抽象性、前瞻性和系统性。The intellectual property Law adopts the language and concepts of traditional jurisprudence,but the construction of integrity society mainly uses the resources of utilitarianism and political economy.In the context of building the integrity society,there is another yardstick for judging whether the actions of various subjects in the field of intellectual property are legal and legitimate,this yardstick is credit.Traditionally,the legal system of each country is held in the form of regulating infringement,breach of contract and illegal and criminal acts.Dishonest behavior is another special category which encompasses the above types of behaviors,this is obviously a new basic way of dividing behavior,Credit terms enter the legal system.In the future,the society may undergo drastic changes in the advancement of honesty incentives and dishonest punishment mechanisms.Contemporary research on credit issues in the field of intellectual property can no longer be specific and responsive,that is,specific responses to real problems,but must be more abstract,forward-looking and systematic.
