冲突鉴定意见解决机制研究——以笔迹鉴定为视角

摘　　要：鉴定意见是发现事实真相和解决案件争议的关键证据,然而在实践中针对同一鉴定事项,有时呈现不同的意见,甚至可能出现截然相反的结果,致使人们对鉴定意见产生争议和质疑,法官面对冲突鉴定意见时难以采信。以笔迹鉴定为视角,运用案例分析、比较和逻辑分析方法分析后可知,产生冲突笔迹鉴定意见有诸多因素,可以归纳为启动程序、鉴定材料、技术标准、重新鉴定等方面的原因。我国应尽快通过制定样本收集规范、完善重新鉴定程序、加强鉴定意见综合审查等手段构建冲突鉴定意见预防机制,通过优化鉴定人出庭作证、专家复核鉴定和参加审判等构建冲突鉴定意见选择机制,不断完善司法鉴定管理体制,更好地发挥司法鉴定为诉讼服务的功能和价值。Appraisal opinion is the key evidence to find the truth and solve disputes in cases.However,for the same appraisal matter,different opinions even completely opposite results may appear in practice,resulting in disputes and doubts on appraisal opinions.So it is difficult for judges to accept conflicted appraisal opinion.From the perspective of handwriting identification,based on case analysis,comparison and logical analysis method,there are many factors resulting in conflicted handwriting identification opinions,which can be summarized as the following reasons such as starting procedure,identification materials,technical standards,reidentification and other aspects.Our country shall construct prevention mechanism of conflicted appraisal opinions by developing sample collection specifications as soon as possible,improving new identification procedures,strengthening comprehensive review of identification.Besides,our country shall build selection mechanism of conflicted appraisal opinions by optimizing appraiser testification in court,expert review and trial to improve judicial identification management system and give better play to the function and value of judicial appraisal for litigation service.
