摘 要:近年来,各国频繁更新或出台国家安全审查规则、启动国家安全审查程序、以危害国家安全为由拒绝部分投资准入,国家安全审查制度的泛化应用已然危及全球贸易投资秩序的正常运作。国际法史表明,只有推行制度合作才能解决安全审查泛滥这类制度竞争所带来的破坏效应。各国共同利益的最大化、国内安全审查制度的趋同、逐渐增多的国际对话与合作、安全审查软法规则的出现,构成安全审查国际协调的共同认知和实证基础。尽管如此,任何法律秩序的形成都并非一蹴而就。安全审查国际协调应当遵循有序推进、先程序后实体、双边和多边并进、软法和硬法"兼施"的客观规律和基本路径。中国应当适时向世界提出自己的国家安全审查协调观,践行以合作共赢为核心的新型国际关系。Many countries have in recent years introduced or updated their national security review(NSR)rules,initiated NSR procedures,and blocked foreign investment on the ground of endangering national security.The widespread use of national security review has already jeopardized the normal operation of global trade and investment order.The history of international law shows that only international cooperation can eliminate the destructive effect of institutional competition,such as abuses of NSR.The maximization of common interests of all countries,the convergence of domestic security review system,the increasing international dialogues and cooperation,and the emergence of soft law rules concerning NSR have constituted the common cognitive and empirical basis of international NSR system coordination.Nevertheless,the formation of any legal order cannot be achieved overnight.The international NSR system coordination should follow an orderly development path:from procedural to substantial coordination,from bilateral to multilateral progress,and from soft law to hard law mode.
