电子档案凭证价值保障需求研究——基于电子证据审查判断的视角

摘　　要：新《中华人民共和国档案法》对电子档案以电子形式作为凭证使用作出了"来源可靠、程序规范、要素合规"的规定。文章以14部对电子证据审查、判断、辨认、鉴真规定较为全面、详尽的法律文件为分析样本,从电子证据应用的视角阐释了"来源可靠、程序规范、要素合规"的具体内涵,解读司法对电子档案凭证价值保障的需求,为单套制背景下电子档案法律效力与证据价值的实现提供有益参考。The new Archives Law of the People’s Republic of China stipulates the use of archival electronic records as evidence, which are source reliability, procedures normalization and element compliance. From the perspective of the electronic evidence application, the specific connotation of source reliability, procedures normalization and element compliance are interpreted by 14 legal instruments as the analysis samples, which stipulate the examination of electronic evidence in detail. Then, to provide reference for the realization of the legal effect and evidence value of electronic records under the background of single-set system, the judicial demands for guaranteeing the evidence value of archival electronic records are analyzed.
