中国农村土地集合信托模式创新与保障机制研究

摘　　要：土地信托作为新型土地流转模式具有重要优势。目前中国开展土地信托试点的地区,大多取得了良好成效。但现有土地信托模式在推广运行中面临诸多制约因素:政府行政管理过多,信托机构数量少、角色单一、发挥职能有限,不能充分实现土地规模化、集约化经营。本文在对全国2001—2020年典型土地信托模式梳理的基础上,从横向突破和纵向突破两种路径提出了创新的土地信托模式:一是构建横向联合机制的农用土地整合开发型集合信托模式,二是深化纵向延伸机制的农业产业链型土地集合信托模式。为保障上述创新模式的高效运行,本文提出了政府、监管当局、信托机构、金融机构、新型农业经营主体和农户"六位一体"的土地信托保障机制,以此促进农业产业链形成,实现农业现代化发展。Land trusts have important advantages as a new land transfer mode.Most of the regions where land trusts are currently being piloted in China have achieved good results.However,the existing land trust modes face many constraints in their promotion and operation:too much government administration,few trust institutions,single role,and limited functions,which cannot fully realize the role of large-scale and intensive land management.Based on the combing of typical land trust modes from 2001 to 2020,this paper proposes innovative land trust modes from two paths of horizontal breakthrough and vertical breakthrough:firstly,a horizontal joint mechanism of agricultural land integration and development type collective trust mode,and secondly,an agricultural industry chain type collective trust mode that deepens the vertical extension mechanism.To ensure the efficient operation of the above innovative modes,this paper proposes a six-in-one land trust guarantee mechanism of the government,regulatory authorities,trust institutions,financial institutions,new agricultural management entities and farmers to promote the formation of agricultural industry chains and the modernization of agricultural development.
