“围猎”与“被围猎”利益链的表现形式及斩断对策——基于86份判决文书的分析

摘　　要：“围猎”与“被围猎”是对行贿和受贿的形象比喻。利益集团“围猎”与官员“被围猎”是当前腐败领域的一个主要表现形式。“围猎”能够成功、官员易“被围猎”的主要原因是双方形成了一个腐败的利益链条,其表现形式包括通过政商勾结形成的利益链、通过行政机关上下级关系形成的利益链、通过权力掮客形成的利益链以及通过建立熟人关系形成的利益链等。利益链形成的原因,主要有政商关系异化、监督效力不足、惩戒威慑力不够以及官员底线意识不强四个方面。要斩断“围猎”与“被围猎”的利益链,必须明晰政商界限,构建“亲”“清”政商关系;强化对官员的监督,提高监督效能;提高腐败行为查处率,增强惩戒威慑力以及加强对官员的廉政教育,转变其人情文化观念。“Hunting”and“being hunted”are metaphors of offering and accepting bribes.Interest groups“hunting”and officials“being hunted”are currently the main forms of corruption.“Hunting”easily successful and officials easily falling hunted are mainly due to the interest chain formed between them which comes mainly in forms of collusion chain between government officials and businesses,the chain between administrative superiors and subordinates,the chain formed by power brokers and the chain formed by acquaintances.Factors accounting for the formation of the chain lie in the degenerated government-business relationship,insufficient supervision,the lack of deterrent power,and officials’indifference of the bottom line.For such interest chain to be broken off,the boundary between government officials and businesses is to be demarcated for it to be both“close”as well as“clean”;official supervision is to be strengthened with its effectiveness to be improved;corruption investigation rate is to be increased for the deterrent power to be enhanced,and integrity education for officials is to be promoted for their notions regarding interpersonal relationship to be transformed.
