论土地承包经营权转让制度的功能定位及法律适用

摘　　要：土地承包经营权转让的主体限于同一集体组织内部的农户,这是修改后的《农村土地承包法》条文内容之一大亮点。新法上的土地承包经营权转让具有调整本集体组织内部土地承包关系的制度功能,故有别于旧法上的土地承包经营权转让,其实质是农户对土地承包权的转让。而且,新法上的土地经营权流转经本次修改之后不对土地承包经营权的内部转让产生影响。立足于内部调整功能,新法上的土地承包经营权转让应当被认定为农村土地承包合同的主体变更或概括转移。承包期延长政策的实施也应当以此为基础,由受让土地承包经营权的本集体农户享有对土地的第三轮承包权利。The main body to transfer the right of contracted land management is limited to the farmers in the same collective organization,which is one of the highlights of the revised Law of the People’s Republic of China on Land Contract in Rural Areas.The transfer of the right of contracted land management under the new law adjusts the contracted land relations within the same collective organization,so it differs from that under the old law.Its essence is the transfer of the right of contracted land management among the farmers.After this modification,the transfer of the right of contracted land management does not affect the internal transfer of the right.Based on the internal adjustment,the transfer of the right of contracted land management under the new law should be identified as the change of main body or general transfer of rural land contract.The contract period should also be extended based on this,and the collective farmers who have the right to contract and manage the land should enjoy the third round of land contract right.
