适度能动司法推进双碳达标——基于实然与应然研究

摘　　要：气候变化事实与法治之间普遍存在着严重不对称的现象,无论是司法对立法和行政的能动纠偏,还是在宏大的国家战略目标下对司法予以必要的指引,都从不同角度对能动司法提出实然与应然需求。能动司法更符合我国气候变化应对的现实,正确理解和把握司法能动性实然与应然的辩证关系,对于气候变化案件的公正高效审理至关重要。气候变化能动司法要有所为有所不为,以适度能动司法为尺度。我国气候变化治理实现双碳达标要发挥比较优势,减排增汇并进,特别是要发掘与拓展碳汇资源,在特定领域创新引领,有所作为,并通过能动司法予以保障。以谦抑性为标志的司法克制主义与司法能动主义既有关联又相互制约,司法实践中要处理好二者之间对立统一的辩证关系。There is a serious asymmetry between the facts of climate change and the rule of law.Whether it is the active correction of legislation and administration by the judiciary,or the necessity of relatively conservative judicial guidance under the ambitious national strategic goals,they all treat the initiative from different angles.The judiciary proposes actual and expected needs.Active justice is more in line with the reality of China’s climate change response.Correctly understanding and grasping the dialectical relationship between judicial initiative and what it should be is essential for the fair and efficient trial of climate change cases.Climate change active justice must do something and not do something,and moderate active justice should be the top priority of the dialectical relationship of climate change active justice.China’s climate change governance to achieve dual-carbon standards must give play to its comparative advantages,reduce emissions and increase sinks,and in particular,explore and expand carbon sink resources,innovate and lead in specific areas,make a difference,and guarantee it through active justice.Judicial restraintism and judicial activism marked by modesty are both related and mutually restrictive.In judicial practice,the dialectical relationship of the unity of opposites between the two should be handled properly.
