摘 要:在互联网新业态蓬勃发展的当下,互联网产业的相关市场界定环节不仅是反垄断法适用中的基础问题,还关乎公民科学研究自由、就业自由、营业自由等基本权利与自由的实现。由于既有相关市场界定立法未能充分关注互联网产业经济活动的特征,立法呈现出笼统抽象、可操作性不强的特点,实践中产生了界定互联网产业相关商品市场与相关地域市场的难题。在《反垄断法》修订之际,借鉴国外立法经验,建议从相关市场界定的考虑因素、相关地域市场的有关规定、相关市场的界定方法、相关市场的时间维度这四个层面着手,进一步完善既有相关市场界定的规则,从而维护公平有序的竞争秩序,使数字技术发展的成果能更好地造福于社会。With the vigorous development of new forms of Internet,the relevant market definition of Internet industry is not only a fundamental issue in the application of anti-monopoly law,but also related to the realization of citizens'basic rights and freedoms such as scientific research freedom,employment freedom and business freedom.Due to the existing relevant market definition legislation fails to pay sufficient attention to the characteristics of economic activities of the Internet industry,the legislation presents the characteristics of generality,abstraction and lack of operability,resulting in the difficult problem of defining the relevant commodity market and the relevant regional market of the Internet industry in practice.In the anti-monopoly law revision,by comparing the foreign legislative experience,it is suggested to further improve the existing rules of relevant market definition from four aspects,namely,consideration factors of relevant market definition,relevant regulations of relevant regional market,relevant market definition method,and time dimension of relevant market,thereby maintaining fair and orderly competition order and make the results of the development of digital technology can benefit the society better.
