京津冀跨区域环评审批权转移法律问题研究

摘　　要：京津冀跨区域建设项目环评文件争议的解决在于明确环评审批权转移的适用条件。京津冀协同发展理念的形成、跨区域环境信息的公开共享及公众参与权的保障落实,为跨区域环评审批权转移提供了强有力的制度基础。面对京津冀地区跨区域环境问题突出、信访纠纷频发、环评联动失调的现状,跨区域环评审批权转移应注重明确跨区域环境影响评价审批参与主体,规范建设项目环评各个阶段审批权转移的适用条件,严格落实跨区域环境影响评价审批监督责任。The resolution of disputes over EIA documents for Beijing-Tianjin-Hebei inter-regional construction projects is to clarify the applicable conditions for the transfer of EIA approval authority.The formation of the concept of Beijing-Tianjin-Hebei coordinated development,the open sharing of cross-regional environmental information and the guarantee and implementation of the public participation right provide a strong institutional foundation for the transfer of cross-regional EIA approval right.Facing the present situation of outstanding cross-regional environmental problems,letters and visits disputes frequently occur,and unbalanced linkage of environmental impact assessment in Beijing-Tianjin-Hebei region,the transfer of examination and approval authority of cross-regional environmental impact assessment should pay attention to clarifying the participants of examination and approval of cross-regional environmental impact assessment,standardizing the applicable conditions for the transfer of examination and approval authority of construction project environmental impact assessment at various stages,and strictly implementing the responsibility of examination and supervision of cross-regional environmental impact assessment.
