摘　　要：格式合同在医疗领域中的运用越来越广泛,但其适用规则在《民法典》施行之前并不清晰,合同双方易产生重大争议;在涉及公共利益、生命健康等领域,尤其应审慎适用格式条款。医疗格式合同不仅关系患者生命健康,还直接影响医患关系。文章立足《民法典》框架下的医疗格式合同,探讨其实践应用情况、限缩解释的益处以及责任承担等,期经过合目的性限缩解释以实现立法意旨,从而构建良好的医疗法律秩序。The application of standard contract in medical field is more and more extensive,but its applicable rules are not clear before the implementation of the Civil Code,and the parties to the contract are prone to major dis⁃putes.In areas involving public interest,life and health,standard contract should be applied with particular care.Medical contract is not only related to patients'life and health,but also directly affects the doctor-patient relation⁃ship.Based on the medical standard contract under the framework of the Civil Code,this paper discusses its practi⁃cal application,benefits and responsibilities of restrictive interpretation,hoping to realize the legislative intention through purposeful restrictive interpretation,and build a good medical law and order.
