摘  要:教育惩戒作为教育活动中不可缺少的部分,应该受到法律的规范。在当代教育发展的新形势下,教育惩戒权入法已成社会共识。厘定教育惩戒权的价值与权能,既能防止受教育权利的泛化,也能防止教育惩戒权力的消解,有利于明确教育惩戒权行使的原则,实现教育惩戒权运行的理性回归,有助于防范教育惩戒权对受教育人合法权利的侵犯。As an indispensable part of educational activities,educational discipline should be regulated by law.Under the new situation of educational development,the law has reached a social consensus on the right of education discipline.It is conducive to clarifying the principle of the exercise of the power of disciplinary education,and realizes the rational return of the operation of the power of disciplinary education by determining the value and power of the power of education disciplinary.it can prevent the generalization of the right to education,the dissolution of the power of disciplinary education and the violation of the legal rights of the educated during the exercise of the right to discipline.
