摘 要:我国«消费者权益保护法»规定了惩罚性赔偿制度,基于打假索赔为目的的“知假买假”相伴而生。然而此法对“消费者”和“欺诈”未明确释明,这导致理论界和实务界对于“消费者”“欺诈”的认定以及知假买假者能否适用惩罚性赔偿产生了争议。本文拟从消费者的界定出发,分析知假买假者的法律地位,同时结合«民法典»厘清“欺诈”的含义,进而论证“知假买假”能否适用惩罚性赔偿规定,最后提出相关立法建议和完善措施。The Consumer Rights Protection Law stipulates a punitive compensation system,the phenomenon of“buying known fake products”appeared in order to obtain compensation for combating fake products.However,this law does not clearly clarify“consumers”and“fraud”,which has led to disputes in the theoretical and practical circles regarding the identification of“consumers”and“fraud”and whether punitive damages can be applied to those who buy fake products.This article intends to start from the definition of consumers,ana lyze the legal status of those who buy fake products,and at the same time clarify the meaning of“fraud”in conjunction with the Civil Code,and then demonstrate whether“buying known fake products”is applicable to punitive damages,and finally proposes relevant legislative suggestions and improvement measures.
