浅析“骗取政策型”虚假离婚的法律应对——兼以法经济学为视角

摘　　要：“骗取政策型”虚假离婚是以相关政策为导向,以经济利益为驱动,以夫妻感情为联结,在拆迁公司、开发商、二手中介等有关方面单独或联手推动下形成的。“骗取政策型”虚假离婚尽管对婚姻关系造成了负面影响,无论从现实情况来看,还是从经济角度考虑,都应采取形式意思主义认可离婚效力。今后应贯彻好离婚冷静期制度、设置好离婚警示制度,综合运用法律法规、政策设计等手段妥善解决虚假离婚问题。“fraudulent policy type”false divorce is formed under the guidance of relevant policies,driven by economic interests and connected by husband and wife’s feelings.It is promoted by demolition companies,developers,second-hand intermediaries and other rele vant parties alone or jointly.In spite of the negative impact on the marital relationship caused by“fraudulent policy type”false divorce,both from the practical situation and from the economic point of view,we should adopt formalism to recognize the effectiveness of divorce,implement the divorce cooling off period system,set up the divorce warning system,and comprehensively use laws,regulations and policy design means to properly solve the problem of false divorce,consolidate marriage and family relations.
