行政执法与刑事司法衔接问题的有关思考

摘　　要：自党的十八届四中全会提出健全行政执法和刑事司法衔接机制以来,行政执法领域有案不移、有案难移、以罚代刑的现象日渐受到公众关注。本文主要从行刑衔接的法律依据、程序、证据转化条件和原则切题,指出了行刑衔接不畅,存在法律制约,以及行政执法和刑事司法实践活动中配套监督审查机制及激励考核机制不完善、执法队伍素质有待规范等问题。由此提出了完善行刑衔接法律规定,建设高素质行政执法队伍,完善执法信息共享平台建设,开展联合执法等建议,以期实现行政执法与刑事司法的无缝衔接。Any cases without transfer or with diffi culty to be transferred,administrative penalty instead of criminal punishment have been increasing concerned by the public since the connection between administration execution and criminal justice was proposed to be improved in the 4th Plenary Session of 18th CPC Central Committee.In the paper,based on the basis and procedures of laws,conditions and principles for evidence transformation,the questions including poor connection between administration execution and criminal justice,restriction by laws,imperfect supporting mechanisms of supervision and review as well as incentive assessment in activities of administration execution and criminal justice,non-standard teams,etc.,were put forward,some suggestions were thereby proposed,such as developing laws on connection between administration execution and criminal justice,building administration execution teams with high quality,improving the construction of a platform for sharing execution information,implementing joint execution,etc.,with a view to seamlessly connecting administration execution and criminal justice.
