论被遗忘权裁判基准的构建--以比例原则切入

摘　　要：被遗忘权这一新兴权利涉及多种利益,如何把握各项利益的平衡是该类案件的关键点。比例原则基于其精神、属性以及功能在被遗忘权案件中具有适用的空间,且其包括的目的正当性、适当性、必要性及均衡性四项子原则为案件中的利益衡量提供了具体的论证思路和分析框架,同时需要注意其在民法案件中适用的限制,以期为中国实现被遗忘权个案正当构建可操作的裁判基准有所裨益。The right to be forgotten,a new right,involves many kinds of interests.How to balance the interests is the key point of this kind of case.The principle of proportionality,based on its spirit,attribute and function,has a space for application in the right to be forgotten cases,and its four sub-principle,i.e.,legitimacy of purpose,appropriateness,necessity and equalization,provide a specific argument train of thought and an analytical for the measurement of interest in cases.At the same time,it is necessary to pay attention to the limitations applied in civil cases in order to build an operational benchmark for realizing the right to be forgotten.
