摘　　要：保护性医疗措施在中国医疗实践中被广泛采用,近年来,随着患者知情同意权利意识的觉醒,因采取保护性医疗措施引发的医疗纠纷日渐增多。针对中国保护性医疗制度存在的与患者知情同意权等权利冲突、法律规定零散模糊缺乏操作性、制度实施社会基础不足等问题,从加强法律原则指导、规范完善法律规定、加强医德医风建设和社会主义价值观弘扬等方面提出解决对策。Protective medical measures are widely used in medical practice in China.In recent years,with the awakening of patients’right of informed consent,medical disputes caused by protective medical measures are increasing.In view of the problems existing in China’s protective medical system,such as rights conflict with patients’right of informed consent,scattered and vague legal provisions,lack of operability,and insufficient social foundation of system implementation,this paper put forward countermeasures from the aspects of strengthening the guidance of legal principles,standardizing and perfecting legal provisions,strengthening the construction of medical ethics and carrying forward socialist values.
