基于法律视角的二手汽车保险赔付率研究

摘　　要：汽车保险一直以来都是我国保险市场上一项十分重要的险种,一般表现为单险种形式,且占据很大的市场份额,是保险行业的重要支柱。近年来,随着二手车行业的不断发展,二手车保险也像是雨后春笋一般快速兴起。但在保险项目的不断扩大下,二手车的保险理赔问题也出现了越来越多的问题。因此,在法律视角下,对二手汽车保险赔付率进行研究。首先,对法律视角的二手汽车保险赔付率的相关问题进行讨论。再通过二手汽车赔付率内部风险、二手汽车赔付率外部风险对二手汽车保险赔付率风险进行分析。最后,通过简化相关法律保险赔付环节及岗位、完善保险法律责任认定制度及流程、创建健全的保险法律赔付监管体系的研究,在合理的法律范围内,提出降低二手汽车保险赔付率的建议,以此来推动二手汽车保险行业稳步健康发展。Auto insurance has always been a very important type of insurance in China’s insurance market.Auto insurance is generally manifested as a single type of insurance and occupies a large market share.It is an important pillar of the insurance industry.In recent years,with the continuous development of the second-hand car industry,second-hand car insurance has also sprung up rapidly.However,with the continuous expansion of insurance projects,more and more problems have appeared in insurance claims for second-hand cars.Therefore,from a legal perspective,the article studies the loss ratio of second-hand car insurance.First,it discusses the related issues of the second-hand car insurance loss ratio from the legal perspective.Second-hand automobile insurance compensation rate risk is analyzed through the internal risk of second-hand automobile compensation rate and the external risk of second-hand automobile compensation rate.Finally,by simplifying the relevant legal insurance compensation links and positions,improving the insurance legal liability identification system and process,and establishing a sound insurance legal compensation supervision system,within a reasonable legal scope,suggestions for reducing the second-hand car insurance compensation ratio are put forward to promote the steady and healthy development of the second-hand car insurance industry.
