摘　　要：《新加坡调解公约》确立了国际商事和解协议跨境直接执行机制,但出于对和解协议监督及维护执行地国家利益等方面的需要,仍有必要建立和解协议跨境执行审查制度。和解协议跨境执行审查制度在审查对象、审查内容、法律效果等方面区别于外国仲裁裁决司法审查制度,兼具支持、监督、控制和解协议质量、权利救济等方面功能。同时,本文从制度模式、基本原则、审查主体、审查范围、权利救济程序等方面对跨境执行审查制度内容进行了分析,并就我国构建跨境执行审查制度作了初步探讨。The Singapore Convention has established a cross-border direct execution mechanism for international commercial settlement agreements,but it is still necessary to establish a review system for cross-border execution of settlement agreements for the purpose of supervising settlement agreements and safeguarding national interests at the place of implementation.Different from the judicial review system of foreign arbitration awards in terms of objects of review,content of review and legal effect,the cross-border implementation review system of settlement agreement has the functions of supporting,supervising and controlling the quality of settlement agreement and right relief.At the same time,this paper analyzes the content of cross-border execution review system from the aspects of system mode,basic principles,subject of review,scope of review and right relief procedure,and makes a preliminary discussion on the construction of cross-border execution review system in China.
