美丽中国视域下草原生态安全保护立法探析

摘　　要：随着“山水林田湖草沙是一个生命共同体”生态治理思想的提出,草原作为生态系统的重要组成部分之一,草原生态安全问题被大家所关注。现今,我国草原生态安全正面临新挑战,草畜矛盾加剧,草原出现“空心化”现象亟待解决。面对草原生态安全新困境,存在草原立法理念、立法价值滞后、政策性条文过多、草原保护法律制度规定欠缺以及立法衔接不畅等立法问题,阻碍了草原生态安全保护。故而在习近平生态文明思想和习近平法治思想的指导下,通过确立契合绿色发展需求的立法理念,立法价值中融合风险预防理念,减少《草原法》中政策性条款的规定,健全草原保护法律制度以及建立立法衔接机制等措施完善《草原法》,以此应对草原生态安全危机。As the emergence of an ecological management of"landscapes,forests,fields,lakes,grasses and sand as a community of life",grassland ecological security has attracted great attention as one of the important components of the ecosystem.Nowadays,our country's grassland ecological security is facing new challenges,the contradiction between grass and livestock has intensified,and the hollowing out of grassland needs to be dealt with urgently.Some legislative problems hinder the protection of grassland ecological security,namely,the lagging idea and value of grassland legislation,too many policy provisions,insufficient regulations on grassland protection legal system and poor connection of legislation.Therefore,under the guidance of Xi Jinping’s thought on ecological civilization and on the rule of law,some measures are proposed to deal with the grassland ecological security crisis,for example,establishing a legislative concept that meets the needs of green development,incorporating risk prevention concepts into legislative values,reducing the provisions of policy clauses in the“Grassland Law”,improving the grassland protection legal system and establishing legislative linkage mechanisms and other measures to perfect the“Grassland Law”.
