摘 要:当下,对失信被执行人进行声誉罚是民事执行迈向声誉治理的一个典型表现。在乎自己声誉的被执行人与在乎自己职业声誉的执行人员是民事执行活动良性开展的重要条件。实践中,失信被执行人声誉罚的信号识别功能不彰、执行人员职业声誉流失的加剧是民事执行中声誉治理存在的主要问题。问题产生的主要原因是对被执行人公权控制属性的实践强化与对执行人员管制性思路的运用及其强化。应当在此基础上重塑民事执行中的声誉治理,使其与“公权控制属性”“管制性思路”形成相得益彰的民事执行治理格局。At present,reputation penalty for the dishonest persons subject to enforcement is a typical performance of civil enforcement toward reputation governance.The persons subject to enforcement who care about their own reputation and the enforcement officers who care about their professional reputation are important conditions for the benign development of civil enforcement.In practice,the signal recognition function of reputation penalty of the dishonest persons subject enforcement is not obvious,and the enforcement officers’professional reputation loss intensifying is the main problem of reputation governance in civil enforcement.The main cause of the problem is the practice strengthening of the public power control attribute of persons subject to enforcement and the application and strengthening of the enforcement officers’regulatory thinking.On this basis,reputation governance in civil enforcement should be reshaped to form a civil enforcement governance pattern that is compatible with“public power control attribute”and“regulatory thinking”.
