摘　　要：推动社会主义核心价值观融入法律政策体系,需要对现有法律政策体系中核心价值观的内容、反映方式以及实施效果进行科学评估。核心价值观是直接写入法律规范好,还是通过制度设计间接体现出来更为科学,应当作为评估的重点。法律体系反映核心价值观,应当与核心价值观朝着同一方向发展前进,但又并非等同于核心价值观,也难以同步复制核心价值观。党的十八大报告关于核心价值观各个要素的表述,需要进一步阐明含义,并与宪法中核心价值观的内容一致起来。核心价值观入法入政策,应当扣住宪法规定的“国家倡导”这一用语,处理好不同层面和不同要素核心价值观之间的关系,对核心价值观与非核心价值观,社会主义核心价值观与资本主义、封建主义的价值观,以及法、政策与道德的调整范围,作必要的区分。既要弘扬核心价值观,又要保护宪法法律赋予公民的权利自由,防止法和政策过度干预道德与社会生活。审判机关在法律文书中运用核心价值观释法说理,不能冲淡甚至抵触法律的规定。To promote the integration of socialist core values into the legal and policy system,it is necessary to make a scientific assessment of the content,manifestation,and effect of the core values in the existing legal and policy system.Directly adding the core values into the legal norms or indirectly having the values reflected through the system design is the focus of the evaluation.The legal system reflects core values and should develop in the same direction with core values,but it is not the same as core values,and it is also difficult to replicate the values simultaneously.The statement of the various elements of core values in the report of the 18^(th)National Congress of the Chinese Communist Party needs to be further clarified and be consistent with the content of the core values in the Constitution.Integrating the core values into laws and policies should anchor around the term“national advocacy”stipulated by the Constitution as well as handle well the relationships between different levels and different elements with the core values.Necessary distinction should be made between the core values and non-core values,the socialist core values and the values of capitalism and feudalism,as well as the scope regulated by law,policy and morality.We should promote the core values,and at the same time,protect the rights and freedoms granted to citizens by Constitution and laws,to prevent laws and policies excessively interfering citizens’moral and social life.The judicial organs applying and interpreting the core values in their legal instruments should not dilute or even violate the provisions of the law.
