区块链视角下平台经济反垄断监管模式创新

摘　　要：平台利用算法权力将数据要素集中起来形成中心权威,这是垄断产生的内在机制,侵犯泄露隐私、"二选一"等法律问题均是垄断的外化。"顶格"处罚等外部惩治措施虽然具有强大的威慑效果,但不能解决垄断根源,监管边际效果递减。消解平台数据垄断权威是监管模式创新的基本思路。区块链作为一项颠覆性技术,以反中心主义为根本特征,能够分布式记载数据,塑造公平的数据世界。以区块链思维创新监管模式,平台内部自我治理与法律外部监管二元互动,代码即法律,调整法律外部监管的重点和方式,是治理平台垄断的必然选择和长久之道。The internal mechanism of monopoly lies in the platform uses algorithm power to gather data to form a central authority. Legal issues such as infringement of privacy and "choosing one of two" are the externalization. Although "top grid" punishments have a powerful deterrent effect, they cannot solve the root cause of monopoly, and the marginal effect of supervision is diminishing. Elimination of platform data monopoly authority is the basic idea of regulatory model innovation. As a disruptive technology, blockchain is characterized by anti-centrism, which can record data in a distributed ledges and shape a fair data world. To innovate the antitrust model with blockchain thinking, the dual interaction between the internal self-governance of the platform and the external legal regulation should be constructed, code is the law. Adjusting the focus and method of external legal supervision is the inevitable choice and long-term way to govern platform monopoly.
