摘 要:后疫情时代,全球经济增长比任何时候都更加依赖跨境数据流动。构建“一带一路”数据跨境风险的系统性应对路径,提升沿线整体数据安全,是确保数字丝绸之路蓬勃发展的关键前提。基于此,有必要转变思路将重心聚焦“一带一路”多元化法律体系背景下的数据跨境传输全过程,搭建涵盖数据传输安全禁输管理体系、数据跨境传输监管管辖体系、数据本地存储豁免体系、数据安全执法体系的跨境数据全流域风险系统应对体系,形成系统性风险防范化解共治进路。(1)数据跨境传输前:建立跨境数据风险分级目录及安全分类管理体系,细化形成与数据安全保护、风险防范相适应的行业级跨境数据传输限制标准;(2)数据传输中前端:扩充数据跨境风险监管覆盖主体,形成覆盖“一带一路”全线发展利益的数据管辖制度,细化《阻断外国法律与措施不当域外适用办法》指南;(3)数据跨境传输中:明晰数据主体允诺本地化存储豁免判定程序,明晰充分保护安全风险评估豁免认定条件;(4)数据传输末端:添设数字经济数据跨境风险合作统一执法机制,缔结跨境电子数据取证多边协议,构建个案化跨境电子数据取证简易程序。In the post-epidemic era,the global economic growth is more dependent than ever on transborder data flows.Building a systematic response path to transborder risks of“Belt and Road”data and improving overall data security along the route are key prerequisites for ensuring the digital Silk Road’s flourishing.Based on this,it is necessary to change our thinking to focus on the whole process of data tranborder transmission under the background of the“Belt and Road”diversified legal system,and to build a transborder data basin-wide risk system response system covering the data transmission security control system,data transborder transmission supervision and jurisdiction system,data local storage exemption system,data security law enforcement system,and form a systematic risk prevention and resolution.Therefore,it is proposed that(1)before data transborder transmission,we should establish transborder data risk classification directory and security classification management system,refine the formation of data security protection,risk prevention appropriate to the industry-level transborder data transmission restriction standards;(2)during the front end of data transborder transmission,we expand the data cross-border risk supervision coverage subject,form a data jurisdiction system covering the development benefits of the whole line of the“Belt and Road”,refine the guide to Measures for Blocking Improper Extraterritorial Application of Foreign Laws and Measures;(3)in the data transborder transmission,we clear data subject promises to localize storage exemption determination procedures,refine the conditions for the identification of full protection security risk assessment exemption;(4)in the end of data transborder transmission,we should establish a unified law enforcement mechanism for transborder risk cooperation on digital economic data,conclude multilateral agreements on transborder electronic data forensics,and construct simple procedures for the collection of transborder electronic data on a case-by-
