摘 要:游戏规则是网络游戏开发的核心环节,游戏规则的设计和表达凝聚了游戏设计者大量的智力劳动和物质投资,体现了较高程度的独创性,具有可版权性,应当受到著作权法的保护。网络游戏中的具体规则应当受到版权法的保护,基础规则、玩家经验总结的规则以及处于公有领域的知识则应当排除在版权保护范围之外。2020年新《著作权法》第3条对作品类型的开放性规定为保护网络游戏在内的新著作权客体留下了空间。随着游戏产业的发展,对网络游戏规则的保护问题亟待立法和司法作出新的回应。Game rules serve as the core link in the development of online games.The design and expression of game rules embodies a large amount of mental work and material investment by game designers,reflecting a high degree of originality,thus is copyrightable,and should be subject to copyright law protection.Specific rules should be protected by copyright law,while basic rules,rules based on player experience,and knowledge in the public domain should be excluded.The newly revised Article 3 of Copyright Law regarding the open provisions on the types of works has left room for the the protection of new copyright objects,including online games.With the development of the game industry,the protection of online game rules calls for new responses from legislation and justice.
